2. Use of the Platform
2.1 Purpose of the Platform and Role of the Operator
This platform serves exclusively for private, non-commercial contact between adult, consenting individuals interested in private sperm donation agreements. The operator solely provides the technical infrastructure (e.g., profile system and messaging function) but does not engage in any mediation, verification, or organization of donations, medical procedures, or legal agreements.
2.2 No Advice or Medical Services
The operator does not provide any medical, legal, or psychological advice. Users are solely responsible for informing themselves about the health, legal, social, and emotional aspects of private sperm donations – in particular regarding:
- Legal parenthood and potential child support or custody claims
- Medical risks (e.g., risk of infection, genetic disorders)
- Psychological and social effects on donors, recipients, and children
2.3 Responsibility of Users
All agreements, medical procedures, or meetings take place solely under the responsibility of the users. The operator assumes no responsibility for actions, content, or arrangements between users – including those outside the platform.
The operator assumes no responsibility or liability for the accuracy, completeness, or adequacy of information provided by users, for the trustworthiness or suitability of other users, or for the outcomes of offline interactions or agreements. All interactions and agreements are made solely at the users own risk.
Each user is solely responsible for knowing and complying with all applicable laws and regulations, especially those governing private sperm donation in their country or jurisdiction.
2.4 Permitted and Prohibited Content and Conduct
The platform may only be used for lawful purposes. The following are expressly prohibited:
- Harassment, threats, discrimination, or other harm to other users
- Publication or distribution of false, defamatory, obscene, or pornographic content
- Violation of privacy or third-party rights (e.g., copyright infringement)
- Identity falsification or deception about one’s own person
- Commercial use of the platform without explicit permission
- Uploading, distributing, or providing images or videos depicting minors (children)
- Distribution of content that violates applicable laws, particularly content glorifying violence, inciting crimes, or containing hate speech

2.6 Monitoring and Reporting

2.9 Legal Notice Regarding Sperm Donation
Private sperm donations outside of medical institutions may, under German law, result in the donor being recognized as the legal father – with all rights and obligations (e.g., child support). Private agreements alone do not provide legal certainty. Legal advice prior to a donation is expressly recommended.
2.10 No Commercial Mediation Through the Platform
The platform is provided exclusively as a private, non-commercial contact platform. Any financial arrangements between users are solely their responsibility and lie outside the control or responsibility of the operator.
3. Account Creation
3.1 Registration and Information
To use certain features of our platform, you must create an account. You agree to provide accurate, complete, and current information during registration. This includes, in particular, username, date of birth, contact information, and other required data.
3.2 Responsibility for Data
You are required to promptly update any changes to your account information to ensure its accuracy. False, incomplete, or misleading information may result in suspension or termination of your account.
3.3 Access Credentials and Security
You are solely responsible for keeping your access credentials (e.g., email address, password) confidential. Do not share your credentials with third parties and use strong passwords to prevent unauthorized access. You are liable for all activities carried out under your account unless you can prove misuse.
3.4 Use of the Account
Your account is intended solely for your personal use. Transfer or disclosure to third parties is prohibited. Violations may result in immediate suspension or deletion of the account.
3.5 Age Verification
To use the platform, you must be at least 18 years old. By registering, you confirm that you have reached this minimum age and meet the legal minimum age in your jurisdiction, if a higher age is required there. We reserve the right to request proof of age verification at any time (e.g., by presenting a valid official identification document). In cases of doubt or discrepancies regarding age, access to the platform may be temporarily restricted or permanently blocked.
3.6 Consequences of False Information
If you provide false or incomplete information during registration or do not meet the minimum age requirement, we reserve the right to suspend or delete your account. Further use of the platform is prohibited in such cases.
4. Termination of Account
4.1 By the User
You may terminate your account at any time without providing a reason. This can be done via the account settings in your user profile or alternatively by sending us a written notice through the contact form or email. Upon termination, your access to the platform will be revoked, and your personal data will be deleted or anonymized in accordance with our Privacy Policy, unless legal retention obligations prevent this.
4.2 By the Platform Operator
We reserve the right to suspend or terminate your account at any time without prior notice, especially if:

After termination of your account, access to the platform will be permanently disabled. All content and data you have uploaded may be deleted or anonymized. Restoration of the account after complete deletion will no longer be possible. Any statutory claims remain unaffected.

The user agrees to indemnify sperm-donor.org, its operators, and appointed third parties from all claims asserted by third parties due to content posted by the user. This also includes the costs of necessary legal defense (including court and attorney fees).

All content on the sperm-donor.org platform — including but not limited to texts, images, graphics, logos, audio, video elements, and software — is the property of sperm-donor.org or properly licensed and is protected by German and international copyright, trademark, and other intellectual property laws.
6.2 License to Use
Users are granted a revocable, non-exclusive, non-transferable license limited to the intended use of the platform. This license does not permit:
- Reproduction, distribution, public display, or modification of the content without prior explicit written permission,
- Commercial use or reuse outside of the platform,
- Use of automated systems (such as bots, scrapers, etc.) to extract content.
6.3 Protection Against Infringements
Any unauthorized use of the content constitutes a violation of the rights of sperm-donor.org or third parties and may be subject to civil and criminal prosecution.
6.4 Notice of Copyright Infringements (Notice Procedure)

7. Liability
7.1 Limitation of Liability
Use of the platform is at your own risk. sperm-donor.org does not guarantee the continuous availability, accuracy, completeness, or security of the offered content and functions.
We are not liable for material or immaterial damages resulting from the use or inability to use the platform, including data loss, technical failures, malfunctions, unauthorized third-party access, or transmission errors — unless caused by intentional or grossly negligent conduct on our part.
7.2 Third-Party Content

8. Donations (Gifts according to § 516 BGB)
8.1 Voluntary Contributions
Payments made on this website are voluntary gifts within the meaning of § 516 BGB. They are explicitly not fees or consideration for services, content, or functions of the platform. Users who make payments do so voluntarily and without any contractual obligation.
8.2 Donation Recipients
Donations are directed to the operator of the website sperm-donor.org, who is named in the Imprint with full name and address. The gift is therefore made to a natural person.
8.3 Use of Donations
Donations serve to support the operation of the website, in particular to cover general operating costs (e.g., hosting, domain, maintenance). However, there is no earmarking – the operator may decide on the use at their own discretion.
8.4 Tax Information
Donations up to an amount of €20,000 per donor within ten years are exempt from gift tax under German law (§ 13 para. 1 no. 12 ErbStG).
The responsibility to check any tax reporting obligations lies with the donor.
Donations are not tax-deductible.
8.5 No Consideration, No Refund Claims
Donations do not entitle donors to exclusive content, features, or other benefits.
There is no contractual agreement with the operator.
Refunds are generally excluded. Recurring (monthly) donations can be cancelled at any time.
8.6 Payment Processing and Fees
Donations made through this website are processed by third-party payment service providers such as PayPal or Stripe. These services charge processing, transaction, and, if applicable, currency conversion fees, which are automatically deducted from the donation amount. The amount received by the website operator is the net amount after deduction of these fees.
For donations made in currencies other than Euro, conversion is performed at the exchange rate applicable at the time of the transaction. The actual amount received in Euros may therefore vary. Donors should be aware of possible additional currency conversion fees charged by the payment service provider.
By making a donation, you agree to the terms and conditions of the respective payment provider used (e.g., PayPal or Stripe). It is recommended that you familiarize yourself with their fee structures and terms of use in advance:

Depending on the payment method chosen (e.g., credit card, international bank transfer, currency conversion), additional bank fees may apply (e.g., credit card transaction fees or foreign transaction fees). These are not part of the standard fees charged by Stripe or PayPal and are entirely the responsibility of the donor.
- Donations from Germany / EU (European cards): 1.4% + €0.25 per transaction.
- Donations from outside the EU (or non-European cards): 2.9% + €0.25 per transaction.
- Currency conversion fee: An additional 1% is charged if donating in a currency other than EUR.
- Donations from Germany / EU: 2.99% + €0.35 per transaction.
- Donations from outside the EU: 3.99% + €0.35 per transaction.
- Currency conversion fee: An additional 2.5% is charged if donating in a currency other than EUR.
- A donation of €10 via Stripe (Germany/EU) results in approximately €9.86 received.
- A donation of €10 via Stripe (International) results in approximately €9.46 received.
- A donation of $10 via Stripe (International, USD → EUR) results in approximately €8.94 received.
- A donation of €10 via PayPal (Germany/EU) results in approximately €9.36 received.
- A donation of €10 via PayPal (International) results in approximately €9.26 received.
- A donation of $10 via PayPal (International, USD → EUR) results in approximately €8.69 received.
If you want to ensure that the full donation amount reaches sperm-donor.org, you may choose to increase your donation manually to cover the fees. Your support is genuinely appreciated!
8.7. Recurring Donations
Recurring donations are voluntary, automatic payments that are charged monthly to your chosen payment method to continuously support the work of sperm-donor.org. You can cancel your recurring donation at any time. After cancellation, no further payments will be charged. However, donations already made are generally non-refundable.
How to cancel your recurring donation:
Recurring donations are processed through the payment provider Stripe. After setting up your recurring donation, you will receive a confirmation email from Stripe with a link titled “Manage Subscription.” You can use this link to independently cancel your recurring donation. If you cannot find this email or experience difficulties canceling, please feel free to contact us. We will assist you with canceling your recurring donation via Stripe. 9. Indemnification and Hold Harmless
You agree to indemnify, defend, and hold harmless sperm-donor.org, its subsidiaries, employees, agents, and partners from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising directly or indirectly from your use of the platform or any violation of these Terms of Service, the Privacy Policy, or any other applicable provisions.
This includes, in particular, claims resulting from:
- Your breach of these Terms of Service or other policies;
- Your violation of applicable laws or the rights of third parties, including other users;
- The publication, transmission, or distribution of content (e.g., texts, images) that infringes the rights of third parties or is unlawful.
You are responsible for all costs arising in connection with the defense against claims based on your conduct or your content.
The user indemnifies the operator against all third-party claims arising from a breach of these Terms of Service by the user or from actions of the user that violate applicable law. This includes the costs of a reasonable legal defense.

11.2 Data Protection and Data Transfers
For users located in the European Union, the General Data Protection Regulation (GDPR) applies. Users outside the EU are subject to their respective national data protection laws, which may be less strict in some cases.

12. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations caused by unforeseeable events beyond its control. This includes, but is not limited to, natural disasters, war, terrorism, riots, governmental actions, pandemics, strikes, power outages, sabotage, technical failures, or unforeseeable personal circumstances affecting the website operator (e.g., illness, accident, family emergencies), provided that no reasonable substitute can be arranged.

13.6. Delivery Address
